Unlike prenuptial agreements which are entered into before marriage, property settlement agreements, often referred to as separation agreements, are entered into during the marriage, in contemplation of a separation or divorce. These agreements are intended to resolve all legal issues arising from the parties' marriage and subsequent separation.
